Description | In a surprise decision today, a state Superior Court judge tossed out the election of Assemblywoman-Elect Gabriela Mosquera and vacated her seat because she did not live in her legislative district for one year before her election, as required by the state constitution.
“Because Respondent Gabriela M. Mosquera had not been a resident for one year before her election of the district for which she has been elected to the General Assembly… she was not eligible for that office at the time of the election,” Judge George Leone wrote in his ruling, which was issued tonight.
Nevertheless, Leone is allowing Democrats to fill the seat temporarily in advance of a November, 2012 special election – presumably with Mosquera. |
