Note all candidates in this race were write-ins but under Alabama law, whenever a race has no candidate file on the ballot for any party ballot line and the race comes down to write ins, write ins decide the race, which happens frequently for races for Constable in a larger county

A total of 187 write-in votes was reported in Mobile County Precinct 80 in 2008, and when one looks at the results, you see close to half before ties have (W) by the winner, showing they were a write-in in an all write-in race.

Charles Burch has held the office as a major party candidate, winning it as a Republican nominee in 2012 for example and in 2016 as well, but in 2016 it had been renumbered to Precinct 67 and the way it works in Alabama, the office is tied to precinct, so reducing precincts in a county reduces the number of places
Description
Constables in Alabama are elected by precinct in counties that maintain the office (except Jefferson County, where they are by Alabama House of Representatives district) and elected on the presidential election ballot.


Whenever a race for Constable has no major party candidate run, the write-ins in fact carry the office, and this frequently happens in Mobile County.


In Alabama, the power to break a tie in any race solely within a county belongs to the Sheriff of the county and in Mobile County the Sheriff often has to break ties for Constable.


No one filed for an on the ballot position in this race, so it was decided by the write-ins

This is an office specified by the Constitution in Alabama, Constables generally have the power of arrest, and about of a Sheriff within their whole county, not outside it, and also the power of a game warden. They can appoint a deputy but a deputy can only have authority within the precinct.


Constables do not receive a salary, they are paid by fees, but in Alabama a Constable is in effect its own law enforcement agency, so in many of the rural counties, a Constable writes you a speeding ticket, they themselves are the law enforcement agency, so you are paying the ticket to the Constable rather than the Sheriff or a local police department
