Description |
This cycle was the first that saw a new primary law in effect for judicial elections. The law made the primary election the important one, as those who advanced to the general election were only the top vote-getters for the number of positions up for election.
Justice Root resigned his seat December 2, 1908, refusing to take office for the new term to which he had just been elected. Justice-elect Stephen Chadwick was appointed early to account for the absence and later Mack F. Gose was appointed to fill Root's position until a special election could be held.
