Justice Hamley resigned his seat in July of 1956 upon being nominated by President Eisenhower for the 9th Circuit Court. Foster was appointed to his seat and ran for a full term in the regularly-scheduled 1956 cycle. There was also a short term election to fulfill the remainder of Hamley's term, which lasted only from December 1956 to January 1957 when Foster was sworn in for the regular term.
