ALBANY - Indicted Assemblyman Anthony Seminerio suddenly resigned his seat Tuesday - and plans to plead guilty to a fraud charge.

Seminerio (D-Queens) issued a letter to Assembly Speaker Sheldon Silver which said his resignation would be effective today, Silver spokesman Dan Weiller said.

A law enforcement source said Seminerio will plead guilty as early as Wednesday to a felony charge of scheming to defraud the public.
