Twelve jurors and one alternate were sworn in Monday in the federal embezzlement trial of former Dallas City Council member James Fantroy, who is accused of stealing thousands of dollars from a development corporation run by a Paul Quinn College.

The jury, consisting of nine men and four women, will decide what role the former four-term councilman played in the disappearance of nearly $50,000 from the coffers of the college's community development corporation, where he served as treasurer.

Mr. Fantroy was indicted for allegedly stealing $20,738 in 2003. U.S. District Ed Kinkeade ruled Monday that prosecutors could not attach evidence of an additional $27,000 they said he stole from the corporation two years earlier. The government had sought to use that evidence to establish criminal intent.

"I'm not saying it couldn't come up later," Judge Kinkeade told the prosecutors, who did not comment on the ruling.
