Description | Jubelirer, R-Blair, and two other senators outlined a measure that would empower the governor to choose a replacement, who would have to be confirmed by the state Senate. Nominees who are state legislators, as Jubelirer was when he was automatically elevated to lieutenant governor in 2001, would have to give up their elected positions once they were confirmed.
Jubelirer and Sens. Jake Corman, R-Centre, and Allen Kukovich, D-Westmoreland, also are sponsoring a separate bill to allow gubernatorial candidates to choose their own running mates.
The constitution currently requires the Senate president pro tempore, the highest-ranking partisan member of the chamber, to become lieutenant governor when that post becomes vacant.
Jubelirer was thrust into the role in October 2001, after then-Lt. Gov. Mark Schweiker became governor when then-Gov. Tom Ridge resigned to become President Bush's homeland security director following the Sept. 11, 2001, terrorist attacks. Jubelirer, however, also kept his Senate leadership post.
John Lawless, at the time a state representative, and two others filed a lawsuit arguing that Jubelirer violated the constitutional separation of powers among the three branches of government by holding down both jobs at once. The courts rejected the lawsuit. |
