Born Parkersburg, West Virginia. He was a descendant of Gen John Dillard.

He arrived in the Pacific West, August of 1849. He worked as a miner until 1860. He was not happy with the rough miners life. He went into the photographing business for the next 2 years. After that he found his calling as a Journalist. For the next 14 years he devoted his life as the editor of "The Evening News" He was a democrat and his newspaper was democratic.

As a married man and always conscientious Democrat. He became an Assemblyman and worked on several important Federal Relations, Public Buildings, Printing, Irrigation Enrollment, and Land Monopoly. Assemblyman Spencer was a quiet dignified, and earnest gentleman, and wields considerable influence with his colleagues.

He married after 1860, to Martha Ann Weir, it appears they only had one child, John O. that died as a baby and is buried next to him without a marker
