InfoJudge Philip J. Carey, 78, who served on the bench of the Cook County Circuit Court for 16 years, was a state senator from 1958 to 1962 and chairman of the Illinois Industrial Commission from 1963 to 1969.

A resident of Orland Park and formerly of the Beverly neighborhood, he died Wednesday in Little Company of Mary Hospital, Evergreen Park.

Judge Carey, who was on the bench from 1976 to 1992, spent most of those years hearing criminal cases. He served as supervisory judge of the criminal division in the Markham branch of Circuit Court.

"He was proud of the fact that he was independent and called them as he saw them," his son Peter said. "Defense attorneys were not afraid to take a bench trial before him. He believed in affording defendants their constitutional right to the benefit of the doubt. Not all judges do."

A 1936 graduate of De LaSalle High School, he earned a bachelor's degree in 1940 from Spring Hill College in Mobile, Ala. After serving from 1942 to 1945 in the Navy, he graduated in 1950 from John Marshall Law School.

He was elected to the Illinois Senate in 1958 and was named its outstanding freshman senator.

Judge Carey served as a member of the Illinois Constitutional Convention in 1970 and was a principal advocate of the home-rule provisions that gave Chicago and other communities greater powers.

Other survivors include his wife, Mary Kathryn; two sons, Philip and John; five daughters, Joan Dornette, Patricia Mark, Kathryn Duhig, Ellen Jakubowski and Frances Seimssen; a brother; a sister; and 20 grandchildren.

Visitation will be from 3 to 9 p.m. Friday in the Donnellan Funeral Home, 10525 S. Western Ave.

Mass for Judge Carey will be said at 10 a.m. Saturday in St. Barnabas Catholic Church, 10134 S. Longwood Drive.
