Description |
Did not take office until May 1, 1985 due to election dispute. Re-elected pursuant to H. Res. 146.
McIntyre was certified as the winner by a margin of 114,278 to 113,860 (with Fallahay receiving 691). [Dubin, p. 740.]
McCloskey challenged the results, and the U.S. House appointed a committee to investigate. McCloskey charged that hundreds of votes were not counted.
The House committee faced several important issues. First, which uncounted ballots should be counted? Second, what criteria should apply to uncounted ballots?
The committee cast a series of party-line votes to count just over 5,000 invalid ballots. The final vote hung on about 90 irregular absentee ballots. The committee voted to count 60 of these ballots but not the remaining 32.
After the counting of the 60 irregular absentee ballots, McCloskey had a lead of four votes. The committee declared him the winner and did not examine the remaining 32 irregular absentee ballots.
The House voted, mostly along partisan lines, to seat McCloskey.
